These General Conditions concern the purchase of products made remotely via the Internet on the site https://www.tsunamipulito.com belonging to Docchem S.r.l., with registered office and operational headquarters in Strada Della Costiera snc, 27020 Dorno (Pv), VAT number 11276550156, tax code and registration in the Pavia Company Register, registration in the Pavia REA no. 246030

Registration on the e-commerce site

When completing the registration procedures on the Site, the Customer undertakes to follow the instructions provided by the Company and to provide truthful, correct and updated personal data. Registration is free of charge. Without prejudice to the fact that the registration procedure for the services is concluded exclusively electronically, the Company will assign each Customer a User ID and Password. The Customer acknowledges that such User ID and Password constitute the system for validating access to the section of the e-commerce site. The Customer acknowledges and agrees that such User ID and Password constitute the only means suitable for identifying him/her when accessing the services. The Customer, therefore, agrees and accepts that all acts performed using the aforementioned User ID and Password will be attributed to him/her unequivocally and will have binding effect on him/her. The Customer acknowledges that he/she is the sole and exclusive person responsible for the acts performed using his/her User ID and Password and undertakes to maintain their secrecy and to guard them with due care and diligence and not to transfer them even temporarily to third parties.

Privacy

The personal data requested during registration or order forwarding are collected and processed in order to satisfy the express requests of the Customer and will not be transferred to third parties under any circumstances and for any reason. Docchem guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree 196 of 30.06.03. The data controller is Docchem S.r.l., Strada Della Costiera snc, 27020 Dorno (Pv).

Acceptance of the general conditions of sale

The contract stipulated between Docchem and the Customer must be considered concluded with the acceptance, even partial, of the order by Docchem. Such acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), once the online purchase procedure has been completed, he/she will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

It is understood that the Company reserves the right, in the event that the Customer violates one of the guarantees provided and mentioned above, to block his/her access to the e-commerce site for a fixed and/or indefinite period and to take the appropriate legal action.

Purchase methods

The purchase of products can be done by following the following steps:

• Registration or purchase as a guest (without registration)
• Authentication using User ID and Password (log-in)
• Choice of product/s
• Completion of the order by entering the data necessary to conclude the contract
• Confirmation
• Verification of the data provided and the conditions of sale
• Confirmation and sending of the order

The order placed by the Customer through the authentication phases with User ID and Password is considered binding and the sales contract will be considered concluded upon receipt by the customer of the order confirmation, except for the rights of withdrawal reserved to the consumer.

The order confirmation will be sent to the email address provided by the Customer during the registration phase and will contain a summary of the conditions of sale, the information and essential characteristics of the goods, the detailed indication of the price, payment methods, withdrawal, delivery costs. If the Company has a temporary unavailability of the products, it undertakes to communicate this promptly to the customer and in any case no later than 30 days. and will provide for the refund of any amount already paid by the Customer, through a refund and/or a voucher corresponding to the value of the goods. It is understood that both the order and the receipt are considered received when the parties have the possibility of accessing them.

Products

The Customer is informed and acknowledges that the illustrative photographs of the products comply with the graphic design of the same. For each product offered, a description of the essential characteristics of the good and its warnings will be available and only these descriptions will be valid for the purposes of identifying the product subject to the sales contract and its characteristics.

Payments

All prices include VAT. The site accepts payments by credit card, PAYPAL, bank transfer or cash on delivery with the addition of € 3.00 for the management of the same by the courier.
In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by Docchem, our company will simultaneously request the cancellation of the transaction and the release of the amount committed. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry (typically 24-25 days from the date of authorization). Once the transaction has been cancelled, in no case can Docchem be held responsible for any damages, direct or indirect, caused by a delay in the failure to release the amount committed by the banking system
For greater guarantee and security of the Customer, at no time during the purchase procedure is Docchem able to know the information relating to the buyer’s credit card, transmitted via a protected connection directly to the site of the banking institution that manages the transaction. No computer archive of Docchem will store such data. In no case can Docchem therefore be held responsible for any fraudulent and improper use of credit cards by third parties, when paying for products purchased on the site https://www.tsunamipulito.com

Payment with PayPal

By selecting the PayPal payment type, the Customer is redirected to a page on the PayPal site where by entering his email address and password he can make the payment. The Customer’s financial data are not shared with Docchem but are managed directly by PayPal. In case of cancellation of the order or non-acceptance by Docchem, the amount will be refunded to the Customer’s PayPal account and Docchem cannot be held responsible for delays and/or damages caused during the refund phase.

Shipping and minimum orders

The costs will be free on the first order. The cost for shipping is € 2.50 for orders under € 29.99, no shipping costs will be applied above € 30.00. The delivery of the product will be commissioned to third-party carriers. From the verification of the payment, deliveries, barring unforeseen events beyond the control of the Company and its partners, will take place approximately within 2/3 days from the carrier taking charge. In any case, delivery times cannot exceed 30 days from receipt of the order, unless otherwise specifically agreed. The Company, from the moment of delivery to the carrier, no longer assumes responsibility for the loss or damage of the goods, except in the case of fraud or gross negligence, just as the Company will not be responsible for any loss or damage subsequent to delivery to the customer, except in the case of fraud or gross negligence. The Company will communicate to the carrier the data provided by the Customer in the order, and will therefore not be responsible for errors or inaccuracies.
For the delivery of the goods, the presence of the Customer or his representative is required at the recipient’s address indicated in the order. Upon delivery of the goods by the courier, the Customer is required to check: > that the number of packages delivered corresponds to that indicated on the transport document > that the packaging is intact, not damaged, not wet or in any way altered, including the sealing materials (adhesive tape or plastic straps). Any damage to the packaging and/or the product or the lack of correspondence in the number of packages or indications must be contested immediately, placing a specific reservation on the courier’s delivery receipt. Once the courier’s document has been signed, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered.
The products purchased on the site can be delivered throughout Italy, including the islands, and in all foreign countries included in the list of countries served. For shipments to the territory of San Marino, Vatican City, Campione d’Italia and Livigno, the recipient of the goods is responsible for paying the taxes and customs duties required by the legislation in force in the territory of destination of the products.

Withdrawal Procedures

Pursuant to the legislation in force, the consumer has the right to withdraw from the purchase contract for any reason and without providing explanations, under the conditions set out below. To exercise this right, the customer must send a communication to this effect, within 14 working days from the date of receipt of the goods. The goods must then be returned at the customer’s expense within 14 days from the date on which he communicated to the Company his decision to withdraw from the contract.

The Customer must send the product carefully packaged in its original packaging, avoiding damaging it with adhesive labels or other and complete with all its original contents, to the address communicated. The shipping costs for returning the goods are borne by the Customer. The shipment, until the certificate of receipt by Docchem, is under the responsibility and risk of the Customer. Upon receipt of the goods, Docchem will verify their integrity and reimburse the Customer for the amount of the product purchased, excluding transport costs.

The Company applies the legal guarantee of conformity provided and protects the consumer in the event of the purchase of defective products, which do not function properly or do not respond to the use declared by the seller or for which the goods are generally intended. The right of withdrawal lapses in the event of a lack of substantial integrity of the returned goods, and thus for example in the event of: > lack of the external packaging and/or the original internal packaging; > absence of integral elements of the product (accessories, etc.); > damage to the product for reasons other than its transport; > abnormal state of conservation. In the event of forfeiture of the right of withdrawal by the Customer, Docchem will return the purchased product to the Customer, charging the same for the shipping costs.

Modification of the conditions of sale

In the event of any modification to these conditions of sale, the Company will promptly publish the new modified conditions of sale on the Site.

The modified conditions of sale will become an integral part of the new contracts, starting from the first order placed by customers, following their publication on the site. In the case of orders already placed before such communication, the previous version of the conditions of sale will apply.
